Filling out a t-47 (T-47 RESIDENTIAL REAL PROPERTY AFFIDAVIT)
A T-47 is used when you are representing the Seller. Title companies will require this form when the Seller has a survey to the property.
Date: Ensure this is blank until you the Seller get this notarized. The notary date at the bottom and date on the top must match.
Name of Affiant: Seller's names.
Address of Affiant: Seller's CURRENT address, it does not have to match the property address that you are selling.
Description of Property: ADDRESS of the home your selling/listing. Ensure the county is correct. Before me, the undersigned notary for the state of __________. This will generally say Texas, unless the Seller is signing in another state.
Par. 1) This should always be blank. The date in this blank should be the date found on the survey. NOT THE DATE YOU PURCHASED THE HOME. There is always a date on the survey, sometimes it can be tough to see.
EXCEPT for the following: Generally, you will put NONE here. If you have made any structural improvements that are not shown on the current survey, this is when you will mark those items down. Structural improvements must be built into/affixed to the property. Examples of structural improvements:Pool, Concrete slab, Additional sidewalks, Retaining Walls, Brick/stone flower bed borders, Sheds/metal storage buildings (that stay with the property) Patio coverings/awnings/decks THAT ARE BUILT IN.
Under par. 6 you the seller will sign IN FRONT OF THE NOTARY.This form must be notarized. Call your local bank or UPS/FedEx store and make sure there is a public notary present. The fee for a public notary ranges generally from $6-$12 dollars.
